Frequently Asked Questions About Record Suspensions in Ontario
1. How long does the Parole Board of Canada take to process applications?
Once your application is accepted as eligible and complete, standard processing times are:
- Summary offences: approximately 6 months
- Indictable offences: up to 12 months
If the Board proposes to refuse, processing may take as long as 24 months
2. What are the official fees and additional costs involved?
In addition to your legal fee:
- $50 payable to Parole Board of Canada for application processing
- $60–$90 for fingerprinting services
- Approx. $40–80 for local police record checks (varies by region)
- Total third-party costs typically range from $150–$200
3. Are there offences that make someone ineligible?
You’re automatically ineligible for a record suspension if:
- You’ve been convicted of a Schedule 1 sexual offence involving a minor
- OR you have more than three indictable offences, each carrying sentences of two years or more
There are extremely limited exceptions for Schedule 1 cases under narrow conditions
4. When does the waiting period begin—and how does "method of trial" affect it?
Waiting begins only after all components of your sentence are fully completed (fines, probation, parole, etc.)
- The waiting period depends on how your first offence was prosecuted:
- 5 years after completion for summary convictions
- 10 years for indictable convictions or if method of trial can't be confirmed
5. What if my charges were stayed or withdrawn?
If your case ended without conviction (withdrawn, stayed, absolute or conditional discharge), you may not need a Record Suspension—those records are typically purged after a year or three automatically.

6. Can I apply for a Record Suspension if I wasn’t convicted in Canada?
Yes — if your conviction was recognized in Canada under the Transfer of Offenders Act, you can still apply for a Canadian Record Suspension through the Parole Board of Canada
7. Does a Record Suspension guarantee travel to the U.S. or other countries?
No. A Record Suspension does not guarantee entry to the U.S. or other nations.
Many jurisdictions don’t recognize Canadian pardons or may still consider the conviction under their rules. In some cases, a U.S. waiver application may still be necessary.
8. What happens if my application is denied?
You may reapply after 1 year, with updated documents (e.g. new police check); you must show good conduct and correct any issues in the initial submission.
9. Will a Record Suspension stop eligible employers from discriminating?
Yes — Ontario Human Rights Code protects individuals who have received pardons from job discrimination based on past convictions
10. Is representation required, or can I apply alone?
You can apply on your own using the official guides. However, a paralegal or lawyer can help ensure accuracy, completeness, and stronger presentation—which can reduce delays or rejections
