The Small Claims Court Process in Ontario – Step by Step

01

Step 1: Filing Your Claim

  • Complete the Plaintiff’s Claim (Form 7A).
  • File online through the Civil Claims Portal or at your local courthouse.
  • Pay the required filing fee.

Pro tip:  Filing errors are one of the most common reasons cases get delayed. Our paralegals make sure your claim is filed correctly the first time.

02

Step 2: Serving the Defendant

  • After filing, you must serve the defendant with your claim.
  • Service must be done properly (personal service, registered mail, or courier).
  • If you serve incorrectly, your case can be dismissed.

We handle service on your behalf so you don’t risk mistakes.

03

Step 3: Defendant’s Response

  • The defendant has 20 days to file a Defence (Form 9A).
  • They may also file a counterclaim against you.
  • If no Defence is filed, you may be able to request a default judgment.

If you’ve been served with a claim, contact us immediately — we’ll prepare your Defence before the deadline.

04

Step 4: Settlement Conference

  • A mandatory settlement conference is scheduled in most cases.
  • A deputy judge will review the case and encourage settlement.
  • Many cases resolve here, saving time and money.

We negotiate skillfully on your behalf — often settling disputes without trial.

05

Step 5: Trial

  • If settlement fails, your case proceeds to trial.
  • Each side presents evidence, witnesses, and arguments before a judge.
  • The judge issues a binding judgment.

We represent you in court with professionalism and strategy, so your voice is heard and your case is strong.

06

Step 6: Enforcement of Judgment

  • Winning a case doesn’t always mean getting paid.
  • If the defendant doesn’t comply, you can enforce the judgment through:
  • Wage garnishment
  • Writ of seizure and sale of property
  • Judgment debtor examination

We don’t just help you win — we help you collect what you’re owed.
